Definition of Terms:

Panel: The RewardingViews market research community
Member: An individual member of the panel
Rewards: The panel point system. Points have no monetary value and cannot be redeemed for cash, auctioned, traded, bartered, sold or transferred.

Conditions of Membership:

Panel membership is open to residents of Australia aged 14 years of age or older. Invitations to surveys and other forms of research are restricted to those aged 14 years or older.

Only one account may be maintained per person. Members are not permitted multiple use of an email address and/or mobile phone number even if the accounts are for different people. You agree that information you provide to the site including any personal details, will be true, accurate and complete in all respects.

Termination of Membership:

A member may terminate their account voluntarily at any time by logging in to the panel site and unsubscribing via the 'Your Account' section. All online survey invites also contain an opportunity to unsubscribe from the panel.

RewardingViews reserve the right to terminate the membership and account of any member without prior notice. Circumstances in which a member shall be terminated include but are not limited to;

- Breaching the terms and conditions of use, or other incorporated agreements or guidelines
- The identification of multiple accounts for the same member
- Inactivity for 365 days or longer
- False or fraudulent responses or other fraudulent activity
- Falsified or intentional misleading personal profile data

When a member is terminated from the panel, all accrued rewards will be cleared along with membership.

Information Submitted:

RewardingViews relies on accurate data to serve its clients, reflecting the true opinions of our members. As a member, you agree to provide truthful and well considered answers to our market research activities. RewardingViews reserves the right to withhold or revoke rewards from a member if we deem a member’s survey question responses are untruthful or not well considered.

By submitting any information, you agree to having the site store (including storage by third party service providers), use, and disseminate data for any reasonable purposes associated with Market Research.

Inappropriate Usage and Content:

You must not email, post or submit any defamatory, offensive, illegal or inappropriate material or any material which infringes a third party’s intellectual property rights or which contains a virus, worm, Trojan horse or other code that manifests contaminating or destructive properties.

You must not attempt to modify or damage the site and must not use the site in connection with any mass distribution of email (spam) or denial of service attack.

You must not impersonate any person or entity or enter a fictitious name or purport to be authorised to represent any entity if that entity has not authorised you to do so in connection with your use of the site.

You must not cause or permit any other person to engage in any of these activities (eg. by providing them with access to your computer or by providing password information to them).

RewardingViews are not liable for defamatory, offensive, illegal or inappropriate content available at the site or accessed from the site and the risk of injury from such content rests entirely with you.

Third Party Material:

The site may include content or references supplied by users or other third parties (“third party material”). We do not monitor and we accept no liability for third party material. Any opinions, advice, statements, services, offers or other information contained in third party material is the responsibility of the respective author(s), distributor(s) or providers of that third party material.

RewardingViews make no representation and give no endorsement of the accuracy, adequacy, currency, suitability, completeness, legality, reliability or usefulness of any third party material or the identity, knowledge or qualifications of any provider of third party material. Your access to and reliance on third party material is entirely at your own risk.

References in third party material to any specific products, process, or service by trade name, trademark, manufacturer, or otherwise, do not constitute or imply their sponsorship, endorsement or recommendation by us, and such references shall not be used for advertising or product endorsement purposes.

Any links to third party web sites from the site are provided solely as a convenience to you. We make no representation as to the intellectual property rights of any material available on the linked third party web sites. We do not review and monitor any linked third party web sites and we are not responsible for the contents, accuracy, adequacy, currency, suitability, completeness, legality, reliability or usefulness of any material on any third party web site and accept no responsibility for any broken or redirected links.

The presence of such links should not be taken to imply any type of association, sponsorship, endorsement, monitoring, approval of, or responsibility for, the linked third party web site or its content. Limitations of Liability:

Neither RewardingViews nor its officers, directors, stockholders, subsidiaries, employees, agents, licensors, affiliates, or other third-party providers shall be held liable for any damages or losses, whether direct, indirect, incidental, special, consequential or exemplary damages resulting from:

- The use or inability to use the panel
- The cost of procurement of substitute goods or services
- Any transaction entered into or through the panel
- The reliance on or use of any information, goods, services or merchandise provided on the panel
- Unauthorised access to or alteration of Member's transmissions or data
- Statements or conduct of any third party
- Any other matter relating to the panel or these terms.

If this limitation of liability provision shall be deemed unenforceable, either in whole or in part, then such parts as are unenforceable shall be deleted, the remaining parts shall remain in full force and effect and the liability of RewardingViews shall be limited to the greatest extent permitted by applicable law.

Confidentiality:

As a member of our panel, you will be exposed to some new products and innovative ideas from our clients and we ask that you do not share any of the information relating to the products or the research activity in which you participated, via any medium.

RewardingViews will terminate a membership at their discretion if they believe a member has shared material containing our client’s intellectual property outside the context of the research activity.

Intellectual Property:

When you become a member, you agree that title, ownership rights, and other intellectual property and proprietary rights in the panel shall remain in RewardingViews and/or its licensors and suppliers.

Through your membership, you acknowledge that the content of the website and the application and the panel - including but not limited to text, sound, photographs, graphics, software or other material contained in RewardingViews e-mail communications, services or software - is copyrighted by RewardingViews and/or its licensors and suppliers under Australian and international copyright laws and author's rights laws. The content of the website and the application and the panel is subject to other intellectual property and proprietary rights and laws, and is owned by RewardingViews or its licensors and suppliers.

Save as otherwise provided by applicable copyright law and/or author's rights laws, such content may not be copied, modified, reproduced, republished, posted, transmitted, sold, offered for sale, or redistributed in any way without the prior written permission of RewardingViews and its applicable licensors or suppliers, with the sole exception that one copy of any necessary software that may be provided by RewardingViews may be downloaded onto a single computer for Member's personal, non-commercial use.

You must abide by all copyright notices, information, or restrictions contained in or attached to any such content.

Any and all survey responses, data and information provided by a member during your participation on the panel including as part of a survey or study, becomes the Intellectual Property of RewardingViews and/or its client or partners. This includes:

- Survey responses
- Images or videos
- Response to open-ended survey questions

Trademarks:

RewardingViews, and the RewardingViews logo, are trademarks of RewardingViews Pty Ltd. Other trademarks, as well as any third-party trademarks, service marks, logos and trade names appearing on the website, the application or through the panel, are the property of their respective owners.

Rewards:

RewardingViews allocate rewards for the following activities:

- Completing or attempting to complete a survey
- Referral of a new and active panel member
- Any other activity as they see fit

Rewards offered will be explicitly specified prior to each activity. The amount of rewarded points required to exchange for a reward item will also be specified prior to the transaction. Each Reward item will have a minimum point requirement to be redeemed. RewardingViews also reserve the right to amend or change point balances up to their discretion. This include if there is a revision made to the point and rewards system.

In the event a member is terminated from the panel, all rewards will be removed along with the member's account.

Prize Draws:

All prize draws will be carried out in accordance with the rules and regulations specified by the laws in Western Australia. Details will be specified prior to the prize draw taking place.

Severance:

If any term or provision of these Terms shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such term or provision shall be deemed null and void and shall not affect the application and/or interpretation of these Terms. The remaining terms or provisions of these Terms shall continue in full force and effect, as if the invalid or unenforceable term or provision was not a part of these Terms.

Governing Law:

These conditions and your use of the site and any disputes between you and us shall be governed by and construed in accordance with the laws of Western Australia, without giving effect to any principles of conflicts of law. Any legal proceedings arising out of or in connection with the use of the site must be commenced in the appropriate court in Western Australia.

You are solely responsible for ensuring that your use of the site is not prohibited and complies with your local laws.

Changes to Site Content:

RewardingViews may modify the content, nature or accessibility of the site as and when we see fit. These conditions will continue to apply even if you cease to be permitted or able to use the site. Please note, these changes may also include revisions to the RewardingViews points and reward system, or an upgrade to the RewardingViews system, where member data and attributes will be carried over onto the new platform.

RewardingViews may also revise these conditions at any time by updating this web page. You are bound by such revisions and should therefore regularly revisit this page to review the then current conditions by which you are bound. Your continued use of the site after a revision of these conditions evidences your acceptance of that revision.
